1. Terms of delivery and payment

The offers, sales, deliveries and calculations are made according to the following conditions, as well as our prices valid on the day of delivery, which we reserve the right to change at any time, insofar our offers and delivery agreements are non-binding. We expressly reserve the right to model changes, misprints and prior sale.

2. Delivery

Parcels up to 31.5 kg are delivered by Österreichische Post AG or DPD Direct Parcel Distribution Austria GmbH. For larger weight units by forwarding with one-way pallets. We are entitled to carry out partial deliveries. We make every effort to meet the delivery dates specified by us. Our obligation to deliver does not apply in the following cases: force majeure, operational disruptions, official measures

which make delivery impossible for us or one of our suppliers.

3. Retention of Title

We reserve ownership of all goods delivered by us until all claims have been paid in full. However, the buyer is entitled to resell the goods to a third party in the ordinary course of business or to process them further. However, upon conclusion of the purchase contract, the buyer assigns to us the claims against his customers arising from the resale with all rights until all our claims from the delivery of goods have been paid in full. At our request, the buyer is obliged to notify sub-orderers of the assignment and to provide us with the information and documents required to assert our claims.

Before all claims have been paid, the buyer may neither pledge the goods nor assign them as security. The reclaiming of the goods delivered under retention of title does not automatically mean a declaration of withdrawal from the contract at the same time. If our property is endangered in any way by the buyer, the buyer must notify us immediately. Balance drawing and balance recognition do not affect the retention of title.

4. Complaint

Complaints regarding obvious defects can only be considered if they are noted on the transport company's transport note upon delivery. Always sign the shipping slip with reservations. In the case of hidden defects, within 5 working days after receipt of the goods.

5. Place of Performance and Jurisdiction

Place of performance and place of jurisdiction: The place of performance for delivery and payment is the registered office of the seller. If the buyer is a registered trader, the exclusive place of jurisdiction for all disputes arising from the delivery contract, including all bill of exchange and check claims, regardless of the amount of the claims for both parties, is the seller's registered office.

6. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is 14 days from the day on which you or a third party named by you who is not the carrier take possession of the item(s) (or the last item if you have ordered several items that were delivered separately). has. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail).
